Terms of Service

Effective date: September 21, 2026

Baseline notice: This is a general starting point for Wynne Foundry’s products and website, written to describe accurately how Remember With Me and Covenant Kids actually work today. It is not a substitute for review by qualified legal counsel, and should be reviewed before being relied on at wider scale — particularly the subscription, liability, and dispute-resolution sections below.

1. Agreement to these terms

These Terms of Service (“Terms”) are an agreement between you and Wynne Foundry LLC (“Wynne Foundry,” “we,” “us,” or “our”) governing your use of wynnefoundry.com and our mobile apps, including Remember With Me and Covenant Kids (together, the “Services”). By downloading, installing, or using a Service, or by visiting our website, you agree to these Terms. If you don’t agree, please don’t use the Services.

Where a Service has its own section below with more specific terms, those terms control for that Service in addition to the general provisions that apply to everything.

2. Who can use these apps

You must be at least 18 years old and legally able to enter into this agreement to create a Family Companion PIN, set up Family Sync, or purchase a subscription. Our Services are intended for use by adults — family members and caregivers — and are not directed at children. Remember With Me’s primary user is often a person living with dementia who may not be able to independently read or agree to these Terms; Section 3 below describes how the app is designed around that reality.

3. Roles inside Remember With Me

Remember With Me distinguishes between two roles:

  • The Member — the person the app is built around, typically someone living with dementia, who uses the app’s primary-user screens (Home, Morning Recap, games, Story Library, and similar).
  • The Care Partner — the family member or caregiver who sets up the app, creates the Family Companion PIN, and adds or manages the Member’s information on their behalf.

Because the Member may not be able to meaningfully consent to these Terms, a Care Partner must set up and manage the app on the Member’s behalf, and does so by affirmatively confirming — when the Family Companion PIN is first created — that they are a family member or caregiver with the authority to act for the Member. By making that confirmation, the Care Partner accepts these Terms both for themselves and, to the extent legally possible, on behalf of the Member, and represents that this arrangement is appropriate given the Member’s circumstances.

If more than one family member becomes a Care Partner through Family Sync (Section 7), each of them independently agrees to these Terms in their own capacity. Wynne Foundry is not responsible for resolving disagreements among Care Partners about how the Member’s information is managed; the household owner’s controls described in Section 7 are the mechanism available for that.

4. Subscription & payment

Remember With Me offers the following plans. All are sold and billed through the Apple App Store or Google Play, not directly by Wynne Foundry — we never see or store your payment card details.

  • Free trial. New subscribers get a 1-week free trial. Unless you cancel before the trial ends, it automatically converts to the paid plan you selected, and billing begins at that plan’s price.
  • Monthly — $9.99/month.
  • Yearly — $89.99/year.
  • Lifetime — a one-time payment of $179.99, offered as a limited-time promotion intended for the first 1,000 purchasers. This is a promotional offer: we may modify or end it at any time and without notice — including changing the price, changing or removing the number of purchasers eligible for it, or discontinuing it entirely — at our sole discretion. Doing so doesn’t affect anyone who already completed a Lifetime purchase; that purchase continues to grant access to Remember With Me for as long as we continue to operate the Service, subject to these Terms. A Lifetime purchase isn’t a guarantee the Service will be offered indefinitely, and doesn’t cover future paid add-ons we may introduce separately from the core app.

For Monthly and Yearly plans:

  • Auto-renewal. Your subscription renews automatically at the end of each billing period unless you cancel before it renews.
  • Cancellation. You can cancel anytime through your Apple ID or Google Play account subscription settings. Cancelling stops future billing; it does not retroactively refund the current period.
  • Price changes. If we change subscription pricing, we’ll provide notice as required by the app store you subscribed through before the change applies to you. Price changes don’t apply to a completed Lifetime purchase.

Refunds (all plans) are handled by Apple or Google under their own refund policies, since they process the payment — we’re glad to help point you to the right place, but we don’t control or issue refunds directly.

5. Your content, and other people’s

“Your Content” means the photos, voice recordings, names, stories, facts, and other information you or a Care Partner add to Remember With Me. As described in our Privacy Policy, this content stays on your device by default — Wynne Foundry does not receive or store it unless you use an optional feature that specifically sends it somewhere (Family Sync settings, or a file you deliberately share).

You keep all rights to Your Content. Because it doesn’t pass through our systems in the ordinary course, we don’t need — and don’t take — a license to it beyond what’s needed to operate the specific optional feature you choose to use.

Information about other people

A “People” entry, a Story, or a Remember-practice fact often describes someone besides the Member — a daughter, a grandchild, a friend. You’re responsible for only adding photos, recordings, names, and stories about other people that you actually have the right or standing to share — for example, because you have a close family relationship with them or their own permission. Wynne Foundry has no way to verify this and isn’t a party to those family relationships; you agree to indemnify us as described in Section 15 if a claim arises from content you added about someone else.

6. Voice recordings

Remember With Me’s recording features are built for you to record your own voice, telling your own story, and submit it yourself. Don’t use the app to record another person without their knowledge — for example, secretly recording a phone call or a conversation. Some states require every participant in a conversation to consent before it’s recorded, and it’s your responsibility to comply with those laws wherever you’re recording from.

7. Family Sync & sharing

Family Sync is optional and lets multiple devices in a household stay in sync on app Settings only (not People, Stories, Places, Calendar, or Remember-practice content — see the Privacy Policy for the technical detail). The person who creates a household is its owner and can approve or remove members, transfer ownership, and delete the household. If you’re added to someone else’s household, you’re bound by these Terms in your own right, and the household owner’s decisions about membership (including removing you) are theirs to make.

“Send Something From Here” lets you package an entry and hand it to your phone’s own share feature (Mail, Messages, or similar) to send to whoever you choose. That transmission happens through your own messaging or email provider, under their terms, not ours — we’re not a party to that transfer and have no visibility into it.

8. Acceptable use

Please don’t use the Services to:

  • Upload or share content you don’t have the right to share, or that’s unlawful, abusive, or infringing;
  • Attempt to access another household’s Family Sync data without authorization;
  • Reverse-engineer, decompile, or interfere with the apps’ normal operation;
  • Use the Services for any purpose other than personal, non-commercial use by a family caring for the Member; or
  • Violate any applicable law in how you use, record, or share content through the app.

We may suspend or terminate access for use that violates these Terms.

9. Deletion & termination

You can stop using the Services at any time. Remember With Me includes built-in controls for removing your information:

  • Delete Everything On This Device permanently wipes all local content on that device and resets its Settings.
  • Delete This Household (household owners only) schedules the household’s Family Sync data for permanent deletion, with a 60-day grace period before it’s purged.
  • A household owner can remove an individual member at any time.

Uninstalling the app removes its locally stored content from that device but doesn’t affect a separately synced household’s Family Sync data — use the in-app controls above for that. We may also suspend or terminate your access to the Services if you violate these Terms.

10. Covenant Kids

Covenant Kids is a faith-based children’s activity app. It has no accounts, collects no personal information, and is intended for family use with parental supervision. It’s provided for entertainment and educational purposes; nothing in it should be relied on as professional, religious, or educational advice beyond its intended use as a family activity app. In-app purchases, if any, are processed entirely through the Apple App Store or Google Play under their own terms.

11. Not medical advice, not emergency care

Remember With Me does not diagnose, treat, monitor, or manage any medical condition, including dementia. It’s a memory-and-connection tool, not a medical device, a safety monitoring system, or a substitute for professional care. Nothing in the app or on our website should be read as medical advice. Remember With Me is not designed to detect emergencies, and you should not rely on it for that purpose — if the Member is in a medical emergency, contact emergency services directly, the same as you would without the app.

12. Intellectual property

The Services, including their design, code, and Wynne Foundry’s trademarks and logos, belong to Wynne Foundry LLC or its licensors. These Terms don’t grant you any rights to our intellectual property beyond what’s needed to use the Services as intended. You retain all rights to Your Content as described in Section 5.

13. Disclaimer of warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that any content will be preserved without loss (which is one reason the in-app deletion warnings about photos and recordings not being recoverable exist).

14. Limitation of liability

To the maximum extent permitted by law, Wynne Foundry LLC and its members, employees, and contractors won’t be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, content, goodwill, or profits, arising from your use of the Services — even if we’ve been advised of the possibility of such damages. To the maximum extent permitted by law, our total liability for any claim relating to the Services is limited to the greater of: the amount you paid us in the 12 months before the claim arose; for a Lifetime plan purchase, the amount you originally paid for it; or $100.

Some jurisdictions don’t allow certain limitations on liability, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Wynne Foundry LLC from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Services, Your Content (including content about other people, as described in Section 5), or your violation of these Terms.

16. Apple App Store terms

If you downloaded a Service from the Apple App Store, you acknowledge the following, which are between you and Wynne Foundry, not Apple:

  • These Terms are between you and Wynne Foundry only, not Apple, and Apple has no obligation to provide maintenance or support for the app.
  • Apple has no warranty obligation whatsoever with respect to the app; any warranty claims are Wynne Foundry’s responsibility, to the extent described in these Terms.
  • Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising from consumer protection or similar legislation.
  • Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the app or your possession/use of it infringes a third party’s intellectual property rights.
  • You represent that you’re not located in a country subject to a U.S. government embargo, and are not on any U.S. government list of prohibited or restricted parties.
  • Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Google Play terms

If you downloaded a Service from Google Play, your use is also subject to Google Play’s Terms of Service, and nothing in these Terms limits any rights or obligations you have under Google’s own terms as the store operator.

18. Governing law & disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Services will be brought in the state or federal courts located in Colorado, and you consent to personal jurisdiction there.

19. Changes to these terms

We may update these Terms from time to time. If we make a material change, we’ll update the effective date above and, where appropriate, let you know inside the app. Continuing to use the Services after a change takes effect means you accept the updated Terms.

20. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and Wynne Foundry regarding the Services, and supersede any prior agreements on the same subject. Our failure to enforce any provision isn’t a waiver of our right to do so later.

21. Contact
